1. Acceptance of Terms

By accessing or using the Reclaim Bharosa platform ("Platform"), you agree to be bound by these Terms of Use ("Terms"). If you do not agree, you must not use the Platform.

You represent that you are at least 18 years of age and competent to contract under the Indian Contract Act, 1872.

These Terms are governed by and shall be interpreted in accordance with the laws of India, including the Consumer Protection Act, 2019, Digital Personal Data Protection Act, 2023, Information Technology Act, 2000, and other applicable laws.

2. Description of Services

Reclaim Bharosa provides insurance claim assistance services, including:

  • Assistance with filing new insurance claims
  • Support for rejected or delayed claims
  • Assistance in short-settlement recovery
  • Consultation, documentation support, and claim tracking

Important Disclaimer: Reclaim Bharosa is not an insurance company, law firm, or financial advisor. We act as an independent service provider assisting users in claim-related processes. Final decisions rest solely with insurance companies.

3. User Accounts

3.1 Account Creation

To access certain features, you may be required to create an account. You agree to provide accurate and complete information and to consent to data processing in accordance with our Privacy Policy.

3.2 User Responsibilities

You are responsible for:

  • Maintaining confidentiality of account credentials
  • All activities conducted through your account
  • Promptly notifying us of unauthorized access

3.3 Suspension or Termination

We may suspend or terminate access to the Platform if you:

  • Violate these Terms
  • Engage in fraudulent, illegal, or abusive conduct
  • Provide false or misleading information

Except in cases involving fraud, security threats, or legal obligations, termination shall be preceded by reasonable notice.

You may close your account at any time.

4. User Conduct

You agree not to:

  • Use the Platform for unlawful purposes
  • Upload malicious or harmful content
  • Attempt unauthorized access
  • Misrepresent identity or authority
  • Interfere with Platform security or operations

Violation may result in suspension, termination, or legal action.

5. Service Limitations and Disclaimers

5.1 No Guarantee of Outcome

We do not guarantee claim approval, settlement amounts, or timelines. Outcomes depend on insurer policies and external factors beyond our control.

5.2 Platform Availability

The Platform is provided on an "as is" and "as available" basis. Temporary interruptions may occur due to maintenance, upgrades, or third-party dependencies.

5.3 AI Assistance Disclaimer

Any AI-based assistance provided is informational and assistive only and does not constitute legal, financial, or professional advice under Indian law. Users must independently verify critical information.

6. Fees and Payments

6.1 No Win, No Fee Model

We generally operate on a "No Win, No Fee" basis. Fees become payable only upon successful recovery of claim amounts, as per the specific service agreement communicated to you prior to engagement.

All fees are exclusive of applicable taxes, including GST, unless stated otherwise.

6.2 Refunds

Refund terms, if applicable, shall be communicated at the time of engagement and shall be subject to the specific service agreement.

7. Intellectual Property

All Platform content, trademarks, software, and materials are owned by Reclaim Bharosa or its licensors. Users are granted a limited, non-transferable, revocable license to use the Platform for personal purposes.

User-uploaded documents remain your property, but you grant us a limited license to process and share them solely for service delivery.

8. Limitation of Liability

To the maximum extent permitted by law:

  • We shall not be liable for indirect, incidental, or consequential damages
  • We are not responsible for insurance company decisions or third-party services

Our aggregate liability, if any, shall not exceed the fees paid by you for services in the 12 months preceding the claim.

Consumer Rights: Nothing in these Terms shall limit or exclude statutory rights available to consumers under applicable Indian law.

9. Indemnification

You agree to indemnify and hold harmless Reclaim Bharosa and its personnel from claims arising from:

  • Your breach of these Terms
  • Your violation of applicable laws
  • Content or documents provided by you

10. Force Majeure

We shall not be liable for failure or delay in performance caused by events beyond reasonable control, including acts of God, government actions, system failures, natural disasters, or regulatory changes.

11. Dispute Resolution

11.1 Governing Law and Jurisdiction

These Terms are governed by Indian law. Courts at Mumbai, Maharashtra shall have jurisdiction.

11.2 Consumer Remedies

Nothing in these Terms restricts your right to approach appropriate Consumer Disputes Redressal Commissions under the Consumer Protection Act, 2019.

11.3 Data Protection Disputes

Issues relating to personal data shall be addressed in accordance with our Privacy Policy and applicable DPDP Act grievance mechanisms.

12. Modifications

We may update these Terms to reflect legal or operational changes. Material changes will be notified, and continued use constitutes acceptance, subject to legal requirements.
